BOARD POLICY SERIES NUMBER: 2020

 

TITLE:  THE BOARD OF EDUCATION

 

1.         Board Membership.  The Linn-Benton Community College Board of Education shall consist of seven members each of whom is elected by the electors within District zones.  Members reside within the zones from which they are elected.

In the event that a member of the Board is not able to complete a term of office, the Board will appoint a replacement to serve until a new Board member is duly elected and assumes office. (Such an election will occur as prescribed by Oregon State Law.)

 

2.         Term of Office.  Board members are elected to fill a four-year term of office except in those cases where a Board member has been elected or appointed to fill an unexpired term.

 

3.         Board Authority.  Board members shall have authority only when acting as a Board legally in session.  The Board cannot be bound in any way by statements or actions by individual Board members.  Any duty imposed upon the Board, as a body, must be performed at a regular or special Board meeting at which time a quorum is present and a motion is carried by a majority of the Board members of the total Board and must be a matter of record.  A member who abstains may be counted toward making the quorum, but an abstention cannot be used to make up the minimum number of votes required to pass or reject a motion.  The consent to any particular measure obtained from individual members when not in session is not an act of the Board and is not binding upon the District.

 

4.         Duties and Responsibilities of the Board.  The duties of the Board of Education are:

 

A.        To select and appoint the President, Chief Executive Officer of Linn-Benton Community College;

 

B.        To determine policies which will govern the operation of the college and to adopt policies for the governance of the college and review them annually;

 

C.        To appoint candidates to vacant Board positions;

 

D.        To adopt the annual college budget, establish tuition and fees and levy the taxes;

 

E.        To authorize contracts, award bids for goods and services, and authorize budget transfers;

 

F.         To consider and act upon appointment or dismissal of regular employees upon the recommendation of the President;

 

G.        To fix the rate of compensation for employees and to review all salary schedules annually;

 

H.        To consider and act upon recommendations of the President on matters relating to college facilities;

 

I.          To require and consider reports from the President concerning the programs and condition of the college;

 

J.         To consider and act upon new program offerings of the college upon the recommendation of the President;

 

K.        To consider and adopt a college calendar;

 

L.         To consider recommendations of the President on all matters relating to the welfare of the college;

 

M.        To provide for the establishment of the necessary policies to assure proper account of receipts and disbursements of college funds and those of student organizations and other funds under the supervision of the college;

 

N.        To provide for an annual independent audit for all funds of the college;

 

O.        To authorize needed elections on matters that call for a vote of the people;

 

P.        To consider communications and requests from citizens and organizations on matter of policy and administration;

 

Q.        To authorize the college President to establish citizen advisory committees and curricular or professional technical advisory committees;

 

R.        To approve college admission standards;

 

S.        To provide and disseminate public information relating to the college programs, operations, and finances;

 

T.         To apply for federal, state, local, or private funds and accept and enter into contracts or agreements for the receipts of such funds and to appropriate such funds by resolution;

 

U.        To develop rules for the use of and access to District public records that are consistent with Oregon law;

 

V.        To adopt traffic and parking regulations necessary for the policing and control of vehicles on property under the jurisdiction of the Board;

 

W.       To review and approve gifts of art presented to the college for permanent display on campus;

 

X.        To execute such powers which are essential to the accomplishment of the purposes for which the Board was created within the exercise of judgment and discretion.

 

Y.         To consider any other duty or responsibility allowed or required by law, or execute such other powers expressly conferred upon the Board by statutes or fairly implied by expressed grants.
